According to court documents earlier this year, rapper Kodak Black (born Dieuson Octave) was arrested in Florida on multiple charges, including drug possession, child neglect, and possession of a weapon or ammunition by a delinquent. He was also charged with violating felony probation or community service. The arrest followed an Instagram Live video that took place in the house were Black lives, in which Black’s infant son was seen in the bathroom along with people who were “rolling what appears to be a cannabis cigarette” and then holding said cigarette “inches away” from the child. They were also seen “playing with what appears to be a Sig Sauer handgun.”
Black’s lawyer, Bradford Cohen, filed a motion to dismiss all charges on Thursday, as first reported by TMZ. In an email to TrackRecord, Cohen confirmed that the state attorney voluntarily dismissed three counts: grand theft of a firearm, child neglect, and possession of a firearm, ammunition, or weapon by a delinquent.
“The remaining two charges we are still working on to get dismissed,” Cohen said. Those charges are one count of possession of cannabis over 20 grams and two counts of violating felony probation or community control.
Cohen argued that there was no evidence that the guns and the drugs in the Instagram Live video were real or that they belonged to Black. He writes in his motion to dismiss, “Indeed, the Defendant and his musical ‘Sniper Gang’ crew often produce music videos and other promotional videos, as is customary in the industry, using fake firearms and narcotics.” He also states that Black “shared his residence with other individuals.”
Kodak was also indicted on first-degree sexual assault charges last year. He is currently awaiting trial.
